Public Notice - DAB Hearing No. 2/2021 55 James Avenue
Under Sections 213 to 227 of The Planning and Development Act, 2007 and the City of Yorkton Zoning Bylaw No. 14/2003:
55 James Avenue is a property subject to a Development Appeals Board Hearing. The appellant has applied for a Development Permit to construct an accessory building (detached garage). The proposed detached garage would contravene the City of Yorkton Zoning Bylaw No. 14/2003, Section 4.5.41 and 4.5.3 for the following reasons:
- The combined accessory building's floor area will exceed the area of the principal dwelling by 252 ft2.
- The applicant proposes to install metal roofing whereas the roofing of the principal building is comprised of asphalt shingles.
For these reasons, a Development Permit has been denied. The applicant has appealed the refusal, and is requesting relaxation of the Zoning Bylaw Requirements to the parameters described above.
The appeal will be heard by the Development Appeals Board for the City of Yorkton at 5:00 pm on Wednesday, December 8, 2021 in Council Chambers, Main Floor, City Hall. Should you have any comments, either in favour of or opposed to the appeal, you may either voice them at the Development Appeals Board Hearing, or you may submit them in writing.
Any responses received are considered public information and are made available for review upon request. Written submissions should reference 'DAB No. 2/2021' and be delivered by 12:00 noon, Thursday, December 2, 2021 to the Secretary of the Development Appeals Board. They can be hand delivered to the City Clerk's office at 37 Third Avenue North, 2nd Floor, or emailed.
